1. Agreement to these Terms
These Terms and Conditions (“Terms”) are an agreement between you and Eternal Lessons LLC, the Virginia-based operator of Eternal View (“Eternal Lessons,” “Eternal View,” “we,” “us,” or “our”). By creating an account, accepting an invitation, affirmatively accepting these Terms, or using Eternal View, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.
A sponsoring employer or organization may have a separate program agreement with Eternal Lessons. That agreement governs the Sponsor’s commercial and administrative relationship with us. It does not give the Sponsor rights to your coaching content, reduce your rights under these Terms, or make you responsible for the Sponsor’s payment obligations.
2. Employer-sponsored program and eligibility
Eternal View is available only through an employer or other organization that funds or arranges a coaching program (the “Sponsor”). You must be at least 18 years old, be invited or otherwise eligible for the program, use only your own identity, and be legally able to enter this agreement. Sponsorship may determine whether you have access and for how long. It does not give the Sponsor an Eternal View account, product-administration rights, or access to your private coaching information.
If you use Eternal View as a Coach or authorized Eternal Lessons administrator, you represent that you have authority to perform that role. An outside-feedback recipient may use only the invitation addressed to that person.
3. What Eternal View provides
Eternal View provides tools for approved Coach and Client accounts, private coaching relationships, asynchronous prompts and responses, private and shared notes, goals, homework, tracked metrics, calendar coordination, recordings, and invited outside feedback. Features may change over time. Access to a feature may depend on role, active relationship, administrator approval, recipient consent, provider availability, Sponsor eligibility, or a separate written agreement.
4. Roles and the Sponsor boundary
A Client controls what optional information to provide and what supported content to share with an authorized Coach. A Coach may access only assigned, active relationships and is responsible for applicable professional duties, coaching agreements, informed-consent practices, confidentiality, and recordkeeping. An Eternal Lessons practice administrator has only limited directory, approval, and allocation access and cannot view coaching relationships, recordings, notes, answers, or activity.
The Sponsor may know that it offered you a program and may administer eligibility outside Eternal View. Eternal View does not provide the Sponsor with individual sign-in or participation status, coaching activity, profiles, calendars, prompts, answers, notes, goals, homework, metrics, recordings, references, feedback, progress, performance, or outcomes. We may exchange only limited contracting, invoicing, eligibility, seat-allocation, or scheduling information and, if separately agreed, aggregate or de-identified program statistics that are not reasonably capable of identifying a Client.
Neither Eternal View nor its information may be used for hiring, promotion, compensation, discipline, termination, workplace surveillance, or another employment decision. A Sponsor cannot require Eternal View or a Coach to disclose content in violation of these Terms or the Privacy Policy.
5. Coaching and important limitations
Eternal View is a technology service for leadership coaching, not a medical, mental-health, emergency, legal, financial, employment-law, or other licensed professional service. Coaching is not therapy, crisis care, an employee-assistance clinical service, or a guarantee of any personal, professional, or business result. A Coach is responsible for the coaching services that person provides; Eternal View’s approval of an account is not a warranty of a particular credential or outcome.
If you face an emergency or may harm yourself or another person, contact local emergency services or an appropriate crisis resource rather than using Eternal View. Use your employer’s designated human-resources, ethics, compliance, safety, or reporting channels for workplace matters that require an official employer response; Eternal View is not such a channel and does not report coaching submissions to the Sponsor.
6. Accounts and security
Provide accurate information, use only your own identity-provider account, keep your devices and sessions secure, and promptly tell us about suspected unauthorized access. Invitation links and signed media links are credentials: do not forward or publish them. Coaches and Clients must not share accounts or attempt to enter another person’s workspace. We may suspend a session or account to protect people, investigate abuse, comply with law, or enforce these Terms.
7. Confidentiality and information shared outside Eternal View
Eternal View enforces role- and relationship-based product boundaries, but each person remains responsible for information that person exports, repeats, screenshots, downloads, or copies to another system. A Coach must handle Client information consistently with applicable confidentiality duties and the coaching agreement. A Client should understand whether a note or response is owner-private or deliberately shared before submitting it. An invited recipient must understand who can view a response and that the subject Client does not receive access through the invitation link.
Do not use ordinary email, text messaging, or Sponsor systems to send private coaching content unless everyone involved has independently determined that the method and disclosure are appropriate.
8. Your content
You retain ownership of content you submit. You give us a limited, non-exclusive license to host, process, transmit, display to authorized users, protect, back up, and delete that content only as necessary to operate, secure, and support Eternal View and meet legal obligations. This license ends when the content is deleted, except for protected backups, legal records, or information lawfully retained under the Privacy Policy.
You represent that you have the rights and permissions needed to submit content and that doing so does not violate law, confidentiality duties, intellectual-property rights, privacy rights, or these Terms. Feedback submitted about another person must be honest, relevant to the coaching purpose, and provided without harassment, discrimination, or retaliation.
9. Recordings and outside feedback
Recording is optional. Do not record or upload another person without all notices and permissions required by applicable law and professional obligations. Each person whose voice or image will be recorded must understand the purpose, intended viewers, and available choice not to record. An outside-feedback recipient must affirm recording consent before using the recording workflow.
Eternal View uses a private invitation only for its stated feedback request. Recipients must not forward the link, impersonate someone else, or include information they lack authority to disclose. Recordings are not used for facial recognition, speaker identification, emotion recognition, employment scoring, or AI training.
10. Reference invitations and text-message terms
A Client chooses the people invited to give private feedback and supplies their contact information. A mobile number is optional, and email remains available without SMS authorization. Before entering a mobile number, the Client must have the person’s permission to provide that number to Eternal View and receive the invitation and reminders for the named survey. For every entered number, the Client—not the intended participant—must check a separate, initially unchecked Eternal View SMS authorization. No participant signature is required. The checkbox explains that:
- the sender is Eternal View, a service of Eternal Lessons LLC;
- the texts are non-marketing invitations and reminders for a private feedback request;
- up to five texts may be sent per authorized feedback request: an invitation on day 1 and reminders on days 3, 5, 6, and 7 from the initial text. Reminders stop on completion or STOP. Missed reminders are skipped, not sent together;
- message and data rates may apply;
- the recipient may reply STOP to opt out or HELP for help; and
- consent to receive a text is not a condition of purchase or participation in coaching.
By checking the box, the Client authorizes Eternal View to send this invitation and reminder schedule and confirms that the intended recipient already gave permission for the Client to provide the number and request these specific messages. The Client retains the disclosure, affirmative written reply, date, and mobile number. Older one-text permissions do not authorize reminders. The Client may not use a purchased or scraped number or check the box for a person who has not agreed. Changing the number clears the checkbox, and Eternal View retains a versioned, timestamped attestation receipt and related delivery, provider, opt-out, and suppression records as described in the Privacy Policy.
Recipients may withdraw permission at any time by replying STOP or contacting us. STOP cancels remaining texts and notifies the inviting Coach. No reminders are sent after feedback is completed. Carriers are not liable for delayed or undelivered messages. For help, reply HELP or email admin@eternalview.org.
11. Acceptable use and sensitive information
You may not use Eternal View to break the law; harass, threaten, discriminate against, exploit, retaliate against, or deceive anyone; send unwanted messages; upload malware; probe or bypass security; scrape the service; impersonate another person; interfere with availability; reverse engineer except where law permits; expose another person’s private information without authority; or conduct covert employment surveillance, an employment investigation, or an automated or manual high-impact employment decision.
Do not submit medical records, diagnoses, treatment information, health-insurance information, genetic information, government identification numbers, financial-account credentials, biometric identifiers, classified information, export-controlled information, or other information that the relevant coaching feature does not request. Free-form discussion of personal context does not turn Eternal View into a health, legal, or official workplace-reporting service.
12. Third-party services
Eternal View relies on third-party infrastructure, identity, media, email, calendar, security, and, when enabled, SMS services. Use of a third-party account or feature may also be governed by that provider’s terms and privacy policy. We are not responsible for a third party’s independent service, but we select and configure providers to support Eternal View’s security and privacy boundaries.
13. Our service and intellectual property
Eternal View, its software, design, branding, documentation, and related intellectual property belong to Eternal Lessons or its licensors. Subject to these Terms, we grant you a limited, revocable, non-transferable right to use the service for its intended employer-sponsored coaching purpose. These Terms do not grant rights to our trademarks or permit resale, sublicensing, or creation of a competing service from non-public parts of Eternal View.
14. Program access, availability, and fees
The Sponsor, not the Client or invited recipient, pays for Eternal View under a separate agreement. We do not charge a Client or outside-feedback recipient through Eternal View. A Sponsor’s refund, billing, and renewal terms are governed by its agreement with Eternal Lessons.
We work to keep Eternal View available, but the service may be interrupted for maintenance, security, provider outages, or events outside our control. We may add, remove, or change features. Access may end if eligibility, the coaching relationship, the Sponsor’s program, or the Sponsor agreement ends. Ending sponsorship does not transfer coaching content to the Sponsor and does not eliminate privacy rights or lawful retention obligations.
15. Ending use, sponsorship, and deletion
You may stop using the service at any time. You may use available controls or contact Eternal Lessons to request account assistance, access, or deletion. The ordinary in-product Client deletion workflow requires separate Client and active-Coach confirmations to prevent either person from unilaterally destroying a shared coaching record. That workflow does not let a Coach or Sponsor veto a statutory privacy right; direct privacy requests are evaluated under applicable law, lawful exceptions, and the rights of other people.
We may suspend or terminate access for material breach, security risk, loss of program eligibility, legal requirement, Sponsor-program discontinuation, or service discontinuation. When practicable, we will provide reasonable notice of a non-urgent termination. Sections that by their nature should survive—including ownership, confidentiality responsibilities, disclaimers, limitations, dispute terms, and responsibility for prior conduct—survive termination. Retention and deletion are governed by the Privacy Policy.
16. Disclaimers
To the fullest extent permitted by law, Eternal View is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant uninterrupted or error-free operation, delivery of every message or invitation, continued Sponsor funding or eligibility, or a specific coaching, professional, employment, or business outcome. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.
17. Limitation of liability
To the fullest extent permitted by law, Eternal Lessons and its personnel will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, goodwill, opportunities, or data arising from Eternal View. For claims subject to a monetary cap, our aggregate liability will not exceed the greater of the amount, if any, you personally paid us for Eternal View during the 12 months before the event giving rise to the claim or US $100.
Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, a breach of confidentiality or privacy obligations where such liability cannot lawfully be limited, or any other liability or remedy that applicable law does not permit us to exclude or limit.
18. Responsibility for claims
To the extent permitted by law, you are responsible for direct losses and reasonable costs resulting from your intentional unlawful use of Eternal View, knowing violation of another person’s rights, or knowing failure to obtain required recording or messaging permission. We will give reasonably prompt notice of a third-party claim and allow reasonable participation in its defense. You are not responsible for a claim to the extent it was caused by Eternal Lessons’ unlawful conduct, security failure, breach of these Terms, or instructions.
19. Virginia law and disputes
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law rules. Subject to any non-waivable right to bring a claim elsewhere, a dispute relating to these Terms or Eternal View must be brought in a state court with jurisdiction in Fairfax County, Virginia, or the United States District Court for the Eastern District of Virginia.
Before filing a formal claim, you and Eternal Lessons agree to send written notice describing the issue and make a good-faith effort to resolve it for 30 days. This requirement does not prevent either party from seeking urgent injunctive relief, using an available small-claims process, reporting a concern to a regulator, or exercising a right that cannot lawfully be restricted. Nothing in these Terms limits non-waivable consumer, employment, privacy, or data-protection rights.
20. General terms
These Terms, the Privacy Policy, and any additional terms you affirmatively accept are the entire agreement between you and Eternal Lessons about your use of Eternal View. The Sponsor’s separate agreement controls only its commercial and administrative relationship with Eternal Lessons. If one provision is unenforceable, the remaining provisions continue. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a business reorganization or transfer, subject to the Privacy Policy. No Sponsor or other third party receives a right to enforce these Terms against a Client.
21. Changes and contact
We may update these Terms by posting a revised version with a new effective date. For a material change, we will normally provide at least 30 days’ advance notice and request renewed acceptance when required by law or when the change materially affects your rights. An urgent legal or security change may take effect sooner with notice as soon as reasonably practicable. Changes apply prospectively and do not give a Sponsor access to coaching information, create new SMS permission, override an opt-out, or authorize a new AI use.
